本书特色
国际司法互助学说上有广义与狭义之分，广义之司法互助一般乃是依据1990年联合国一系列之国际刑事司法合作模范公约进行定性，范围可涵盖引渡、狭义之司法互助、判决以及执行之承认、跨国移交受刑人以及刑事诉讼移管等；而我国长期以来虽与各国以及中国大陆军有密切之司法互助合作，惟乏一综整我国内国法、与重要国家签署之司法互助协定以及相关法院裁判之参考手册，因此本书除试图透过内国法规、重要协定协议、行政规则以及重要国际公约之汇整，呈现我国在司法互助实务上之实践依据外；更重要的是透过各级法院民事、刑事案例之蒐集，一窥这些跨国、跨境司法互助案件经由各管道取证后，相关之证据是否为各级法院所採纳，来呈现我国各级法院之相关见解。
